The petitioner seeks bail in a case registered under Section 395 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. This is a case of misuse of privilege of bail. The petitioner was earlier granted bail by this Hon'ble Court. The petitioner is in custody since 01-08-2019. He has already remained in custody for approximately six months. The petitioner undertakes that he will not misuse the privilege of bail and cooperate in the trial.

Considering the aforesaid facts and circumstances, the petitioner, named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like

Patna High Court CR. MISC. No.11645 of 2020(2) dt.28-02-2020 2/2 amount each to the satisfaction of learned Additional District & Sessions Judge-IV, Bhojpur at Ara in connection with Sessions Trial No. 347A of 2013 arising out of Udwantnagar P.S. Case No. 174 of 2012.
