JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-07-2021 Heard Mr. Ashok Kumar Mishra, learned counsel for the petitioner and Mr. Anish Chandra, learned counsel for the informant. The State is represented by the learned APP.
This application has been filed for modification of the order dated 18.06.2019, passed by Hon'ble Mr. Justice Vinod Kumar Sinha, as he then was, in Cr. Misc. No. 13651 of 2019. By the aforesaid order, the petitioners were granted provisional bail subject to the
Patna High Court CR. MISC. No.11781 of 2020(8) dt.12-07-2021 2/3 condition for their facilitating the return of the victim to the matrimonial fold. The order further disclosed that in case the victim is accommodated in the family, the provisional bail of the petitioners shall be confirmed. The learned counsel for the petitioner has submitted that they are parents-in-law of the informant. They have tried their best to ensure the normalization of the relationship between the informant and her husband but to no avail.
However, the husband of the informant has already been granted anticipatory bail subject to the condition that he shall pay a fixed amount of money as monthly maintenance to the informant.
Considering this aspect of the matter, this Court deems it appropriate to modify the order dated 18.06.2019.
The provisional bail granted to the petitioners is, hereby, confirmed. The petitioners shall remain on the same bail-bonds. The petition stands allowed.
Patna High Court CR. MISC. No.11781 of 2020(8) dt.12-07-2021 3/3 The order dated 18.06.2019 stands modified to the extent indicated above.
