The petitioners apprehend their arrest in connection with Gogri P.S. Case No. 372 of 2019 for the offence under

Patna High Court CR. MISC. No.10816 of 2020(2) dt.03-03-2020 2/2 Sections 341, 323, 307, 325, 354(a), 504 and 506/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners have got no criminal antecedent. He further submits that the occurrence took place on 27.10.2019, but the written report was lodged on 31.10.2019. Learned counsel for the petitioner invited the attention of the Court the contents of the F.I.R., which indicates that after due deliberation the fardbeyan was typed out and lodged in connection with the instant case. Referring to the prosecution case, he submits that there is no specific overt act against any of the petitioner and the allegation of assault is general and omnibus.

Considering the aforesaid, the petitioners named above, in the event of arrest or surrender before the court below within one month from today, are directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Gogri P.S. Case No. 372 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anil Kumar Upadhyay, J) uday/- U T
