The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 409 of the Indian Penal Code.

It is alleged against the petitioner that the amount payable to Jamuna Mistry under the PMGY scheme has been given to one Jamuna Sharma by the petitioner which is a case of embezzlement of government fund.

Patna High Court CR. MISC. No.21884 of 2021(3) dt.21-11-2022 2/3 It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner was working as Rural Housing Assistant of Barachatti Block, Gaya and he was not the disbursing officer to transfer the PMGY amount in the account of the beneficiaries. In fact, the amount was transferred with user ID and password of B.D.O, Barachatti in the account of beneficiaries since it comes in the domain of B.D.O., Barachatti and the B.D.O, in order to save his skin has lodged the present case against the petitioner.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with
