2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, altogether 142 litres of country made liquor has been recovered from inside and outside of the house of the petitioner.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case. He further submits that no incriminating article has been recovered from his conscious possession and the house in question is a joint property.

5. Learned APP for the State has opposed the bail prayer of the petitioner and submits that petitioner carries one criminal antecedent and recovery has been made from the house of the petitioner. He further submits that petitioner is not entitled to the privilege of anticipatory bail in view of decision of the Full Bench of this Hon'ble Court rendered in the case of Ram Vinay Yadav vs. The State of Bihar reported in 2019(2) P.L.J.R. 1089 (F.B.).

6. Considering the aforesaid decision of this Court, the prayer for grant of privilege of anticipatory bail to this petitioner is rejected.
