The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 414/34 of the Indian Penal Code.

Prosecution case relates to recovery of stolen Bolero car in which, three persons were sitting including the petitioner, were arrested on spot.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. The said car was being driven by co-accused Anil Kumar and petitioner took lift from him in the way. Petitioner was not knowing the fact that the said vehicle in stolen one. He has no criminal

Patna High Court CR. MISC. No.16062 of 2023(2) dt.29-04-2023 2/2 antecedent and languishing in judicial custody since 12.12.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Motihari, East Champaran in connection with Dumariyaghat P.S. Case No. 267 of 2022.
