2. The petitioner seeks bail in connection with Birpur P.S. Case No. 16 of 2024 instituted for the offences under Section 392 of the Indian Penal Code.

3. Prosecution case, in short, is that four unknown miscreants came on two motorcycles and after threatening the informant on gunpoint, looted one motorcycle, cash amounting to Rs. 11,500/- and one mobile phone from the informant.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Petitioner is not named in the F.I.R. The name of the petitioner transpired in this case on the basis of confessional statement of

Patna High Court CR. MISC. No.12248 of 2025(2) dt.27-03-2025 2/2 the co-accused Diwana Kumar. No incriminating/looted article has been recovered from the conscious possession of the petitioner. Learned counsel further submitted that petitioner has got no concern with the looted articles. Learned counsel further submitted that T.I.P. has not been conducted till date. It has been submitted on behalf of the petitioner that the petitioner is in custody since 04.09.2024 and has five criminal antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. Learned APP further submitted that the prayer for grant of bail to the coaccused person has already been rejected by a coordinate Bench of this Court vide order dated 05.03.2025 passed in Cr. Misc. No. 7144 of 2025.

6. Considering the aforesaid facts and circumstances of the case as also nature and gravity of offence, this Court is not inclined to grant bail to the petitioner at this stage.

7. Accordingly, the prayer for grant of bail to the petitioner is, hereby, rejected.
