Petitioners are apprehending their arrest in connection with Harnaut PS case no. 323 of 2016 registered for the offences punishable under Sections 341, 323, 326, 504/34 of Indian Penal Code.
From perusal of FIR, it appears that petitioners and informant side are agnates and an altercation took place between them on 07.12.2016. In para 11 of the petition, petitioner has stated that petitioner no. 1 is a student and petitioner no. 2 is an old person and own uncle of the informant. In para 3 of the statement on affidavit, it is stated that petitioners have no criminal

Having regard to the fact that petitioners and informant side are agnates and petitioners have no criminal antecedents, let the abovenamed petitioners, in the event of their arrest or surrender within four weeks from the date of receipt/ production of a copy of this order, be released on bail on their furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate-V, Nalanda at Biharsharif or successor Court in Harnaut PS case no. 323 of 2016 subject to the conditions enumerated under Section 438(2) of Code of Criminal Procedure.
