The petitioner is apprehending his arrest in connection with Parsa Bazar P.S. Case No. 79 of 2015 for the offences instituted under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case the informant was sitting on chair outside her nursing home and her husband was coming from the dispensary-cum-residence after sitting at his office at Jai Mata Di Nursing Home and they were talking to each other during the course of discussion the husband Sanjay Singh (deceased), the persons riding on red colour scooty came there and the pillion rider fired a shot on her husband after hearing the fire shot when the informant saw the scooty. She identified both persons pillion rider Nitish Kumar aged about 20 years made a fire shot and the

Patna High Court Cr.Misc. No.8902 of 2016 (3) dt.08-04-2016 scooty was drive by Majoj Kumar and the fire shot hit at the eye of the husband of the informant due to that he fell down outside the nursing home gate and during the course of the treatment he died.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. Petitioner is not named in the FIR. Except for the suspicion, there is no other circumstantial evidence to show regarding the implication of the petitioner.

On behalf of the State, it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Parsa Bazar P.S. Case No. 79 of 2015 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
