JUSTICE BIRENDRA KUMAR ORAL ORDER 01-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 147/148 /149 /341 /323/326 /447/307/302/504/506 of the Indian Penal Code. The accusation of commission of injury at the head of the husband of the informant, which resulted in death, is against co-accused Raju Rai. There is general and omnibus allegation against other accused including the petitioner. Submission is that co-accused Ravi Ranjan and another have already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.6864 of 2017.

Considering the aforesaid facts, let the petitioner,

Patna High Court Cr.Misc. No.20233 of 2017 (2) dt.01-05-2017 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VIII, Muzaffarpur/Successor Court, in connection with Sessions Trial No.5 of 2017, arising out of Paroo P.S. Case No.47 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
