The petitioner seeks bail in a case registered under Sections 461, 379 and 411 of the Indian Penal Code. Allegation is that the accused persons including the petitioner were fleeing away with theft battery of tower of ATC company and carried the same in maruti car, but they were apprehended by the informant with the help of the villagers. It has been submitted on behalf of the petitioner that the petitioner is in custody since 02.01.2020 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. The allegations made in the F.I.R. is denied by the petitioner. It is further submitted that

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail after completion of three months in custody from 02.01.2020 on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar in connection with Katihar Muffasil P.S. case No.01 of 2020.
