JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-05-2017 Heard learned counsel for the petitioner and the State. The petitioner is an accused in Bhorey P.S. Case No. 200 of 2016 registered under sections 279 and 414 of the Indian Penal Code and read with Section 25(1-b)(a) and 26 of the Arms Act.

In paragraph 3 of the petition there is statement that petitioner has no criminal antecedent.

At the time of arrest of the petitioner, he was unconscious. He was taken to referral hospital on 30.10.2016 for treatment and after release from the hospital, he was taken to judicial custody on 16.11.2016.

Having regard to the fact that he was unconscious position at the time of arrest and he has also remained in custody

No.20185 of 2017 (2) dt.29-05-2017 2/2 for more than six months and there is no criminal antecedent as stated in para 3 of the bail petition, I am inclined to enlarge the petitioner named above, on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial MagistrateXII, Gopalganj, in connection with Bhorey P.S. Case No. 200 of 2016 (G.R. No. 3337 of 2016), subject to the condition that the petitioner will extend all cooperation in the trial and will not, in any manner, influence the evidence or the witnesses.
