JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 15-03-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for grant of anticipatory bail arises out of Gamhariya P.S. Case No. 113 of 2015, disclosing offences under Sections 302, 328 and 201/34 of the Indian Penal Code. On the basis of suspicion that the deceased died of poisoning, allegedly administered by the accused persons, petitioner and others have been implicated. The husband of the deceased is also an accused along with other family members. The petitioner is said to be the second wife of Siken Yadav, the husband of the deceased.

It is submitted on behalf of the petitioner that the husband of the deceased had been granted regular bail by the court

Patna High Court Cr.Misc. No.7313 of 2016 (2) dt.15-03-2016 2/2 below and the other co-accused persons have been granted anticipatory bail by this Court's order dated 15.12.2015 passed in Criminal Miscellaneous No. 55403 of 2015.

Keeping in view the fact that similarly circumstanced accused persons have been granted bail, this application is allowed.

Let the petitioner, above-named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Gamhariya P.S. Case No. 113 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present herself before the police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
