JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-04-2019 This is an application for grant of anticipatory bail in connection with Jehanabad P.S. Case No. 533 of 2018, disclosing offences under Sections 420, 465, 471 of the Indian Penal Code and Section 66(C) (D) of the Information and Technology Act.
Allegation as per F.I.R. is that the informant received an unknown call from Mobile No.8348090986 on his Mobile No.9113745534 claiming to be the officer of Union Bank of India and asking the informant to provide the details of his account, otherwise his ATM card will be blocked and after believing the caller, he disclosed his card number and other information to the caller and thereafter he came to know that three transactions worth Rs.25,000/-, Rs.19,999/- and Rs.5,000/- in total of Rs.49,999/- have been withdrawn from his account
Patna High Court CR. MISC. No.12996 of 2019(3) dt.30-04-2019 2/2 and the petitioner is not named in the F.I.R., later on his name transpired on the basis of confessional statement of co-accused person.
Submission of learned counsel for the petitioner is that except confessional statement there is absolutely nothing against the petitioner and he has no criminal antecedent. Further submission is that other co-accused person has been granted privilege of anticipatory bail by this Court vide order dated 30.01.2019 passed in Cr. Misc. No. 76545 of 2018. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed and the provisional bail granted to petitioner vide order dated 05.03.2019 is confirmed. (Vinod Kumar Sinha, J) Amjad/- U T
