The petitioner seeks bail in Kudhani P.S. Case No. 378 of 2016 registered under Section 379 of the Indian Penal Code.

The informant lodged a case for theft of motorcycle bearing registration no. BR06AM4020 against the unknown. During the course of investigation, motorcycle bearing registration no. BR06AK4258 was recovered from the possession of Chandan Kumar and one Pulsar motorcycle bearing registration no. BR06AH9552 was recovered from the possession of the petitioner, Rahul Kumar. Aakash Kumar is said to have confessed his guilt and disclosed that the petitioner was also involved in committing theft of the motorcycle of the informant,

Patna High Court Cr.Misc. No.21328 of 2017 (2) dt.10-05-2017 2/2 but the same motorcycle was not recovered from the possession of the petitioner rather the motorcycle was recovered from the possession of Aakash Kumar.

Considering the facts aforesaid and the fact that the petitioner is in jail since 05.01.2017, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Muzaffarpur in connection with Kudhani P.S. Case No. 378 of 2016.
