Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Pirbahor P.S. Case No. 626 of 2022 lodged under Sections 461, 379 of the I.P.C.

As per the prosecution case, the F.I.R. has been lodged against one named and two unknown accused persons in which allegation of theft in a shop is there. It has also come in the F.I.R. that in C.C.T.V. camera, three boys were entered in the market.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Learned counsel submits that petitioner is a female having friendship with accused Rishu Kumar and petitioner's name has figured in

Patna High Court CR. MISC. No.15908 of 2023(2) dt.05-06-2023 2/2 this case only due to the reason that there is telephonic / mobile contact between Rishu Kumar and the present petitioner. Counsel submits that petitioner is in custody since 08.10.2022 having clean antecedent. Counsel further submits that the said Rishu Kumar has been granted bail by the Coordinate Bench of this Court vide order dated 10.05.2023 passed in Cr. Misc. No.6691 of 2023.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Patna in connection with Pirbahor P.S. Case No. 626 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
