The petitioner seeks bail in Ballia P.S. Case No. 228/2016, registered for the offences punishable under Section 30(A) of the Bihar Excise (Amendment) Act, 2016. The allegation is that the petitioner Golu Kumar and Rangila Kumar were apprehended while fleeing away after seeing the police on Bolero jeep bearing registration no. BR 09H-9482. On search, 206 litres of different brands of Indian made foreign liquor was recovered.
Learned counsel for the petitioner submits that petitioner is in jail since 26.10.2016. Two persons arrested while they were carrying the liquor to deliver the same to Rajnish Singh and others.
Patna High Court Cr.Misc. No.15775 of 2017 (2) dt.24-04-2017 Considering the facts aforesaid and the fact that the petitioner has already remained in jail for six months, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Ballia P.S. Case No. 228/2016.
