JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 08-06-2017 Heard learned counsel for the petitioner and the State The petitioner is in custody in connection with Bakhtiarpur (Kanariya O.P.) P.S. Case No. 390 of 2015 for the offences under Sections 25(1-b)a, 26 and 35 of the Arms Act. The FIR was lodged by the Officer-in-charge, Kanariya O.P. against the petitioner and other co-accused including Phulan Yadav. It appears that co-accused Phulan Yadav was granted bail by this Court in Cr. Misc. No. 22547 of 2016 vide order dated 1.8.2016 considering the fact that nothing was recovered from his possession and charge sheet has already been submitted in the case.

The case of the petitioner is similar to the case of said

Patna High Court Cr.Misc. No.22377 of 2017 (2) dt.08-06-2017 2/2 Phulan Yadav, who has been granted bail by this Court. In that view of the matter, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri M.Kumar, Judicial Magistrate, Saharsa or the successor Court in connection with Bakhtiyarpur (Kanariya O.P.) P.S. Case No. 390 of 2015, G.R. No. 2870 of 2015, subject to the condition the petitioner will extent full cooperation in the conclusion of the trial and will not, in any manner, influence the witnesses.
