The petitioner seeks bail in Bochahan P.S. Case No. 16 of 2017 registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code and under Sections 25(1-B)a, 26 and 35 of the Arms Act.

The police got information that some persons had assembled to commit offence and raided the place and arrested the petitioner and others. From the possession of the petitioner one loaded country made pistol with cartridges was recovered. Learned counsel for the petitioner submits that the petitioner is in jail since 13.01.2017 and he has got no criminal antecedent.

Considering the facts aforesaid and the fact that for

Patna High Court Cr.Misc. No.21094 of 2017 (3) dt.19-06-2017 2/2 recovery of one loaded country made pistol with cartridges the petitioner has already remained in jail for more than six months and he has got no criminal antecedent, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-cum-Sub Judge, 11th Muzaffarpur in Bochahan P.S. Case No. 16 of 2017.
