2. The petitioner seeks bail in connection with Chapra Town P.S. Case No. 936 of 2023 instituted for the offences under Sections 447, 341, 324, 307, 302, 34 of the Indian Penal Code.
3. As per prosecution case, there is allegation of stabbing the deceased against the two accused persons including this petitioner.
4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel further submitted that from perusal of the FIR
Patna High Court CR. MISC. No.18504 of 2025(4) dt.17-06-2025 2/3 it appears that there is specific allegation of stabbing the deceased against the petitioner and one Anil Kumar and as a result of which he sustained injuries beside his right ear and also on his back but the said fact is not corroborated by the postmortem report. It has been submitted on behalf of the petitioner that the petitioner is in custody since 06.04.2024 and has no criminal antecedent. The co-accused person has already been granted bail by this Court vide order dated 28.08.2024 passed in Cr. Misc. No. 59187 of 2024.
5. Learned A.P.P. for the State and learned counsel for the informant vehemently opposed the prayer for grant of bail to the petitioner stating that there is direct allegation against the petitioner of stabbing the deceased and as a result of which he died.
6. Considering the aforesaid facts and circumstances of the case, there being direct allegation of stabbing against the petitioner supported by the medical evidence, this Court is not inclined to grant bail to the petitioner at this stage.
7. Accordingly, the prayer for grant of bail to the petitioner is, hereby, rejected.
8. Learned Trial Court is directed to expedite the trial.
9. However, liberty is granted to the petitioner to
