The petitioner is apprehending his arrest in connection with Mehsi P.S.Case No.268 of 2018 , registered for offences punishable under Sections 420, 467, 468, 34 of the Indian Penal Code.

Allegation as per FIR is that the co-accused persons in collusion with the others got sale deed executed with respect to land of the father of the informant by the petitioner and other accused persons.

Submission of the learned counsel for the petitioner is that no details about the land has been given and there is land dispute between the parties and considering the same, the other accused persons have been granted privilege of

Patna High Court CR. MISC. No.12665 of 2019(3) dt.29-04-2019 2/2 anticipatory bail, vide order dated 4.1.2019 passed in Cr. Misc. No.78045 of 2018.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 6th ACJM, East Champaran at Motihari in connection with Mehsi P.S.Case no.268 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
