The petitioner seeks bail in Halsi P.S. Case No. 80 of 2014, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner is alleged to have fired which hit on the chest of the deceased.

Learned counsel for the petitioner submits that the deceased was an accused in murder case of the brother of the petitioner and that is why the petitioner has falsely been implicated in the case. The deceased had criminal antecedent. Considering the facts aforesaid and the fact that the petitioner fired at the chest of Kameshwar Prasad killing him on the spot, I am not inclined to enlarge the petitioner above named

Patna High Court Cr.Misc. No.7872 of 2015 (3) dt.23-04-2015 2/2 on bail. Accordingly, the same is rejected.

The trial court is directed to expedite the trial and conclude the same within one year from the date of receipt/production of a copy of this order. Learned counsel for the prosecution also submits that he is ready to cooperate. (Prabhat Kumar Jha, J.) KKSINHA/- U T
