JUSTICE BIRENDRA KUMAR ORAL ORDER 20-06-2017 Heard the learned counsel for the petitioner, the informant and the State.

This is a petition for grant of regular bail for offence under Sections 323, 342, 373, 379, 376, 368, 498A and 506 of the Indian Penal Code.

This is a case under Section 498A of the Indian Penal Code. The petitioner is husband of the informant. There is allegation of demand of dowry and torture for the same. Further allegation is of forceful solemnization of marriage at the time below the marriageable age. However, the allegation has been leveled after birth of two children from the wed lock. The petitioner is in custody since 03.11.2016.

Submission of the learned counsel for the petitioner is that the petitioner is still ready for restitution of matrimonial life.

Case No. 61 of 2016 to the satisfaction of the Subdivisional Judicial Magistrate, Raxaul at Motihari, East Champaran, or successor Court.
