====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR PANDEY ORAL ORDER 16-05-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The present petition has been filed for modification of order dated 11.12.2024 passed in Cr. Misc. No. 85081 of 2024.
3. Learned counsel for the petitioners submits that it had been inadvertently mentioned in the bail petition that petitioners are on bail in Bahadurpur P.S. Case No. 171 of 2024 due to which it has been wrongly typed as "petitioners bear criminal antecedent of one case in which they are on bail" in paragraph 4 of the order dated 11.12.2024, however, the

He further submits that he has filed supplementary affidavit for bringing on record the fact that petitioners were not on bail in the aforesaid case at the relevant time and they have been granted anticipatory bail in the aforesaid case by the order dated 17.01.2025 passed in A.B.P. No. 823 of 2024 by the learned Court of Additional District and Sessions Court - II, Patna City. He further submits that due to pendency of the aforesaid Bahadurpur P.S. Case No. 171 of 2024 petitioners could not furnish their bail bonds and, hence, he prays that the time granted for surrender may be extended for further period of four weeks from today. Accordingly, he prays that the order dated 11.12.2024 may be modified to the aforesaid extent.
4. Learned A.P.P. does not controvert aforesaid submissions advanced by the learned counsel for the petitioners.
5. Considering the submissions advanced on behalf of the parties, in Paragraph 4 of the order dated 11.12.2024, let the words "petitioners bear criminal antecedent of one case in which they are on bail" be read as "petitioners bear criminal antecedent of one case" and the time granted for surrender of the petitioners in connection with Bahadur P.S. case no. 337 of 2024 be extended for further period of four weeks from today.

6. Accordingly, order dated 11.12.2024 passed in Cr. Misc. No. 85081 of 2024 stands modified to the extent, stated above.
7. With the aforesaid observation, present modification petition stands disposed of.
