JUSTICE JYOTI SARAN ORAL ORDER 05-08-2015 The contempt application was filed complaining of noncompliance of order dated 04.8.2011 passed in CWJC No. 5640 of 2010 whereby a direction was issued to the District Level Selection Committee, Darbhanga through its Chairman to dispose of the representation filed by the petitioner within three months from the date of receipt / production of the copy of the order. Though the writ petition was disposed of on 04.8.2011 and three month's time had been granted to the District Level Selection Committee to dispose of the representation but the contempt application has been filed almost four years thereafter.

Patna High Court MJC No.656 of 2015 (3) dt.05-08-2015 A show cause has been filed on behalf of the State, a copy of which has been served on counsel for the petitioner on 07.5.2015.

Mr. Ranjan Kumar, Assisting Counsel to SC-14 with reference to the statement made in paragraph-8 of the show cause submits that the claim of the petitioner was considered by the District Level Committee in its meeting held on 02.5.2011 and has been disposed of vide order bearing Memo No. 448 dated 02.6.2011 placed at Annexure-A to the show cause. It is submitted that the Committee found the claim of the private respondent proper and as per the existing guidelines. Though the show cause was served on counsel for the petitioner on 07.5.2015 but no response has been made thereto.

In the circumstances that the order passed in the writ petition stands complied, this contempt application is disposed of reserving liberty to the petitioner to question the order passed by the District Level Selection Committee by filing an appropriate application before appropriate forum.
