The petitioner apprehends his arrest in connection with Hajipur Sadar P.S. Case No. 150 of 2020 registered under Sections 364(A) and 120(B) of the Indian Penal Code. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case due to business rivalry. Further he submits that petitioner is not named in the first information report. Petitioner has no criminal history.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that husband of the informant has taken the name of the petitioner in his statement recorded under Section 164 of Cr.P.C. Hence,

Patna High Court CR. MISC. No.21751 of 2021(5) dt.01-04-2022 2/2 petitioner does not deserve anticipatory bail. Having considered the facts and circumstances of the case and nature of the allegation, this Court is not inclined to grant anticipatory bail to the petitioner.
