It has been submitted on behalf of the learned counsel for the petitioner that he is aware of the view of the Court that the Court does not entertain any application regarding extension of time except on the ground that the modification application has been filed prior to lapsing of the time of surrender. The learned counsel for the petitioner next submits that the petitioner was granted anticipatory bail by order dated 20.12.2022 and the last date of surrender was 02.02.2023 and the petitioner filed the present modification application on 30.01.2023, it is thus submitted that petitioner filed the modification application prior to lapsing of the time of surrender, it is also submitted that the

Patna High Court CR. MISC. No.22314 of 2023(3) dt.10-05-2023 2/2 petitioner is an old and an ailing lady and as such she could not surrender within the time granted as she was not well but still she took care to get the modification application filed prior to the date of surrender lapsing.

In view of the submissions made by the learned counsel for the petitioner the date of surrender is extended by further 3 weeks from today in the event, if petitioner surrenders on or before 31.05.2023 her bail bond shall be accepted on the same terms and conditions as recorded in order dated 20.12.2022 in Cr. Misc No. 44361 of 2022.
