JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-03-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324 and 506/34 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.
The accusation is of making assault and abusing by calling case name.
It is submitted by learned counsel for the petitioners that the injury of the informant has been found to be superficial simple in nature. It is further submitted that for the occurrence of 03.09.2014, the FIR was registered on 05.09.2014 whereas on
Patna High Court Cr.Misc. No.10697 of 2015 (2) dt.18-03-2015 2/2 03.09.2014 itself, petitioner no.2 lodged Sangrampur P.S. Case NO. 102 of 2014 registered for the offences punishable under Sections 323, 307, 379 and 506 of the IPC as the father of the petitioner no. 2 was killed at the hands of the informant and others. The informant is accused no.2 in the case lodged by petitioner no.2.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Munger in connection with Sangrampur P.S. Case No. 103 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
