This application for grant of anticipatory bail arises out of Mansoorchak P.S.Case No. 83/2015, disclosing offences under sections 363 and 366A of the Indian Penal Code. Learned Senior counsel, appearing on behalf of the petitioner, has submitted that the implication of the petitioner is merely on the basis of suspicion. From the First Information Report, it appears that the daughter of the informant disappeared on 6.12.2015 and the First Information Report was lodged on 15.12.2015, making an allegation that the victim used to talk to the present petitioner on cellphone. It has also been said in the First

Patna High Court Cr.Misc. No.7917 of 2016 (2) dt.06-04-2016 Information Report that at one point of time, the informant had seen the victim girl and the present petitioner when they were found talking to each other.

Considering the fact that the implication of the present petitioner is based merely on suspicion, this application is allowed. Let the petitioner, abovenamed, in the event of his arrest/ surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Begusarai in Mansoorchak P.S.Case No. 83/2015, subject to the conditions as laid down under section 438(2) of the Cr.P.C.

This is subject to the condition that the petitioner shall present himself before the police/ court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
