JUSTICE BIRENDRA KUMAR ORAL ORDER 25-04-2017 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners are languishing in custody for offences punishable under Sections 370/374/177/34 of the Indian Penal Code and Section 79 of the J.J. Act.

The petitioners and others were found carrying minor children for labour purpose. The children were apprehended from the train.

Submission of the petitioners is that the children were going to meet their family members working there and no one has supported that the children were going for the purpose of engaging

Considering the aforesaid fact, let petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Rail, Samastipur/Successor Court, in connection with GRP/DBG/SMT P.S. Case No. 110 of 2016, with condition that petitioners shall file undertaking at the time of furnishing of the bail-bond before the Court-below that they would not indulge themselves in such activity otherwise the Court below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioners in this case.
