This application for regular bail arises out of Jokihat P.S. Case No. 316 of 2014, disclosing offence punishable under Sections 302/34 of the Indian Penal Code.
The petitioners are brothers of the husband of the deceased. The deceased was married nearly ten years before the alleged date of occurrence, as has been stated in the FIR. It is the informant's allegation that he learnt about killing of his daughter by her in-laws from others. From whom he received the information and how could he learn that the in-laws were instrumental in killing of the deceased, is not disclosed in the FIR. Patna High Court CR. MISC. No.10443 of 2020(2) dt.29-02-2020 2/2 implicated in the FIR including these petitioners. Considering the nature of accusation, this application is allowed. Let the petitioners, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), each with two sureties of the like amount, each to the satisfaction of learned Judicial Magistrate, Araria in Jokihat P.S. Case No. 316 of 2014.
This is subject to the condition that the petitioners shall present themselves before the Police/ Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
