JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Sikandara P.S. Case No. 09 of 2014 registered under Sections-379, 328, 376 & other minor sections of the Indian Penal Code.

Taking into consideration that there is specific allegation of attempt of rape against the petitioner, I am not inclined to extend the privilege of anticipatory bail to the petitioner and accordingly, prayer for anticipatory bail of the petitioner in connection with Sikandara P.S. Case No. 09 of 2014 pending in the court of Sri R. Narayan, Judicial Magistrate-Ist Class, Jamui/concerned court stands rejected.

Patna High Court Cr.Misc. No.14186 of 2015 (2) dt.06-04-2015 2/2 However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
