In this case, the petitioner is seeking regular bail in connection with Begusarai Town (Ratanpur O.P.) P.S. Case No.424 of 2019 registered for offence punishable under section 25 (1-b) A/26/35 of the Arms Act.

The police on secret information has raided around the house of one Saurabh Kumar and when they reached near bamboo clamp found that five persons were hiding themselves started fleeing away but on chase, one person namely Gopal Kumar was arrested at the spot and he has taken the names of four persons, including the petitioner. The police has recovered the arms and ammunition from the possession of Gopal Kumar.

No.13987 of 2020(2) dt.04-06-2020 2/2 Learned counsel for the petitioner submits that there is no recovery from the possession of the petitioner, though they had fled away from there but the police could not make any search of the body of the petitioner and he is in jail custody since 08.01.2020.

Looking to the facts and circumstance of the case, the petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Begusarai Town (Ratanpur O.P.) P.S. Case No.424 of 2019, subject to the condition that one of the bailors of the petitioner shall be a close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. In case of failure, the prosecution will have liberty to file an application before for cancellation of his bail bond.
