JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 12-04-2016 The petitioner filed the instant application for quashing the notice published in daily Hindi Edition Newspaper "Dainik Jagran" dated 4.2.2016 issued by respondent No.2 so far as it relates to Saharsa district.
The grievance of the petitioner is that though he was empanelled but was not given any work for transportation and yet the respondents have gone for re-advertisement for the purposes of fresh empanelment.
A counter affidavit has been filed on behalf of respondent No.3 wherein in paragraph 14 it has been stated that the petitioner was never appointed or selected in the said panel because he has

He submits that fresh tender has been advertised and it would be open for the petitioner to participate in the same. Having considered the facts and circumstances of the case, this writ application is disposed of with liberty to the petitioner to participate in the fresh tender advertised by the department.
