The petitioner seeks bail in Bihra P.S. case No. 14 of 2017 under Section 307 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act.

The informant alleged that when he came to Panchayat office, Panchayat Secretary and members of Panchayat were not present and Panchayat office was locked but all of a sudden Panchayat Secretary, Vijay Paswan, and Mukhiya, Roshan Kumar Singh, and others, including the petitioner, came and made indiscriminate firing. The informant managed to flee away but Awadhesh Kumar Singh was caught by the accused persons and he was brutally assaulted.

The learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.20459 of 2017 (2) dt.03-05-2017 2/2 injuries found on the persons of Awadhesh Kumar Singh are simple in nature. There is a counter version being Bihra P.S. case No. 15 of 2017. Similarly situated accused, Sanjiv Kumar Singh, Manoj Sharma and Kundan Kumar Singh have already been granted bail. The petitioner is in jail since 03.03.2017. Considering the facts that no specific allegation is made against the petitioner and similarly situated accused persons have already been granted bail, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in Bihra P.S. Case No. 14 of 2017.
