15-06-2020 Heard learned counsel for the parties through video conferencing.

Two petitioners seek bail in Buxar (T) P.S. Case No. 562 of 2019 registered for the offence under Sections 420, 406, 467, 468, 471, 120(b) of the Indian Penal Code. In the F.I.R., the informant has alleged that petitioners have purchased her land by forged and fabricated sale deed. Some other persons have also purchased the said land fraudulently, which was transferred by the informant. In consequence of it, the consideration money i.e. Rs. 25 lacs has been deposited in the Bank account of Surendra Kumar Pandey. Both petitioners happen to be daughter and son-in-law respectively of Surendra Kumar Pandey. It is further alleged by the informant that she is 70 years old lady and by making a

It is submitted on behalf of petitioners that petitioners are innocent and have committed no offence. In fact, they have purchased the land after paying a consideration amount of Rs. 5 lacs & 86 thousand (Rs. 5,86,000/-) and thereafter, the land was mutated in their favour. It is further submitted that main allegation of grabbing money is against other co-accused. Petitioners are simply purchaser of the land and they have no criminal antecedent.

Considering the aforesaid facts and circumstances, the bail application is allowed.

In the event of arrest or surrender within a period of six weeks from today, let the above-named petitioners be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (T) P.S. Case No. 562 of 2019, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Singh, J.) anay U T
