The petitioner seeks bail in Saur Bazar (Patarghat O.P.) P.S. Case No. 23/2017, registered for the offences punishable under Sections 354, 354(A) and 34 of the Indian Penal Code and section 10, 12 of the P.O.C.S.O . Act.

The informant alleged that the petitioner and Md. Imran @ Md. Ebran made lewd comments at his niece while she was going to the institute.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the case. Similarly situated co-accused Md. Imran @ Md. Ebran has already been enlarged on bail vide order dated 12.04.2017 passed in Cr. Misc. 15566/2017. The case of the petitioner stands on the same footing

Patna High Court Cr.Misc. No.15786 of 2017 (2) dt.25-04-2017 and the petitioner is in jail since 16.01.2017. Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that the petitioner is in jail for more than three months, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge Ist-cum-Special Judge, Saharsa in connection with Saur Bazar (Patarghat O.P.)P.S. Case No. 23/2017.
