2. The following reliefs have been sought for by the petitioners in the present writ application:
"1 (A) For issuance of an appropriate writ in the nature of certiorari, or any other appropriate writ, order or direction, to quash the order contained in Letter No. CWCRO-PATOBUSS/23/2025-Business PAT/E-114440 dated 31.01.2026, issued in connection with NIT No. CWC/ROPATNA/BUSS/H&T/CW KISHANGANJ/23/2025-26 dated 07/10.2025 and GeM Bid Document No.
GEM/2025/B/6761859 dated 07.10.2025, insofar as it relates to the termination of the Handling & Transportation Contract of M/s Singh Enterprises, Proprietor: Shri Abhishek Kumar Singh, at Central Warehouse, Kishanganj, the blacklisting of the firm M/s Singh Enterprises and debarring it from participating in any future tenders/bids/procurement processes of the Central Warehousing Corporation for a period of five (05) years with effect from the date of issuance of the order and forfeiture of the Bank Guarantee of INR 27,25,453/- (Rupees Twenty-Seven Lakhs Twenty-Five Thousand Four Hundred Fifty-Three Only) submitted by the petitioners as Performance
3/5 Security.
(B) For issuance of an appropriate writ in the nature of certiorari, or any other appropriate writ, order or direction, to quash the show-cause notice contained in Letter No. CWCRO-PATOBUSS/23/2025Business- PAT/E-114440 dated 20.01.2026. (C) For issuance of an appropriate writ in the nature of of mandamus, or any other appropriate writ, order or direction, restraining the respondents from proceeding further with Tender No. CWCROPATOBUSS/4/2026-Business- PAT/E-117601 dated 01.02.2026, Bid No.
GEM/2026/B/7177203, and for issuance of an appropriate writ in the nature of certiorari for quashing the said tender.
(D) For issuance of an appropriate writ in the nature of mandamus, or any other appropriate writ, order or direction, restraining the respondents from proceeding further with the aforesaid tender process and from issuing any letter of award/work order/agreement.
(E) For issuance of any appropriate writ in the nature of certiorari, or any other appropriate writ, order or direction, quashing the on-spot Letter of Award issued in favour of M/s Tanweer Ahmad, bearing Reference No.
CWCRO-
4/5 PATOBUSS/23/2025-BusinessPAT/E114440 dated 01.02.2026, whereby the said firm has been directed to commence handling and transportation work immediately at Central Warehouse, Kishanganj, being illegal, malafide and arbitrary.
(F) For issuance of an appropriate writ in the nature of mandamus, directing the respondents to allow the petitioners to continue execution of the contract strictly in accordance with the terms and conditions of the agreement and in lawful performance thereof.
(G) For any other order(s) or direction(s) as may be deemed fit by this Hon'ble Court in the facts and circumstances of the present case."
3. Considering the nature of the reliefs sought in the present writ application, the petitioners are directed to file a representation before respondent no. 2, namely the Regional Manager, Central Warehousing Corporation, Regional Office, Patna.
4. In the event such representation is filed, respondent no. 2, namely the Regional Manager, Central Warehousing Corporation, Regional Office, Patna, shall
5/5 consider and examine the same after affording due opportunity of hearing to all the stakeholders and taking into consideration all the documents produced by the petitioners pass a reasoned and speaking order in accordance with law, preferably within a period of six weeks from the date of receipt of such representation.
5. With the aforesaid observation and direction, the present writ application stands disposed of.
6. Pending application(s), if any, shall also stand disposed of.
