JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 20.03.2015 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State.

The contention on behalf of the petitioners is that petitioners are cousin brothers-in-law of complainant's husband and, as a matter of fact, there was matrimonial dispute between the complainant and her husband and being relative of complainant's husband, petitioners have been implicated in this case. It is also pointed out by him that husband of the complainant has filed suit for restitution of his conjugal rights and moreover, after filing of the present case, petitioner no.2 has filed Complaint case against family members of the complainant.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed

Patna High Court Cr.Misc. No.10757 of 2015 (2) dt.20-03-2015 and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in Complaint case no. 207/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
