JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-03-2015 Heard learned counsel for the petitioner as well as leaned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Turkaulia (Banjaria) P.S. Case No. 265 of 2014 registered under Sections-414/34 of the Indian Penal Code and Section11(A)(B)(C)(D)(E)(F)(G)(H)(I)(J)(K) of the Prevention of Cruelty to Animal Act and Sections-47, 48, 49 & 96 of the Animal Rules. According to prosecution case, when the driver of the seized vehicle was apprehended, he disclosed that this petitioner had purchased the vehicle from original owner Vijay Kumar Patel but submission on behalf of the petitioner is that the petitioner has never purchased the vehicle, in question from original owner

Patna High Court Cr.Misc. No.11198 of 2015 (2) dt.20-03-2015 Vijay Kumar Patel and moreover, seized vehicle has already been released in favour of owner Vijay Kumar Patel. Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of the order in the court below, be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Turkaulia (Banjaria) P.S. Case No. 265 of 2014 to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran subject to the conditions as laid down u/S 438(2) of the Cr. P.C.
