The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 341, 342, 323, 324, 384, 379, 504 and 506 of the Indian Penal Code.
It is alleged that the informant and his brother was getting the boundary wall constructed, then the accused persons assaulted, demanded extortion of Rs.3,000,00/- and snatched money.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.13978 of 2015 (2) dt.03-04-2015 petitioners that in the background of land dispute, accusation has been levelled against the petitioner. The specific accusation of assault is only against Sahabuddin and Ajim @ Happa, who are not petitioners before this Court and only one injury has been found to be grievous in nature.
Considering the accusation in the background of land dispute between the parties, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 705 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
