JUSTICE BIRENDRA KUMAR ORAL ORDER 19-06-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 399/402/414/120(B) of the Indian Penal Code, Sections 25(1-AA)/25(1-B)a/26(ii)/35 of the Arms Act and Sections 20/22 of the N.D.P.S. Act. A country-made loaded pistol was allegedly recovered from the possession of the petitioner. Petitioner is in custody since 29.10.2016. The report of the learned trial judge reveals that charges have already been framed on 25.01.2017. However, no prosecution witness has been produced in spite of direction to the Superintendent of Police, Muzaffarpur by the learned Court below.

No.20587 of 2017 (3) dt.19-06-2017 2/2 Considering the aforesaid facts and the period already undergone by the petitioner, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Muzaffarpur/Successor Court, in connection with Maniyari P.S. Case No.200 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
