The petitioner has prayed for bail in a case registered for the offence punishable under sections 419, 420, 471, 467/34 of the IPC, Section 30(a), 32(1)32(2), 41(1) of Bihar Prohibition and Excise Amendment Act.

Prosecution case relates to recovery of 2190.600 litres of liquor from a bus bearing registration no. UP 22AT0249 and two motorcycles which was without registration number. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. To earn his livelihood, he was engaged as conductor in the alleged bus. He has no concern with the alleged recovery. He has no criminal antecedent and languishing in judicial custody since 16.09.2022.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Special Excise Court I, Samastipur in connection with Bithan P.S. Case No. 164 of 2022.
