Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 467, 468, 471, 120B and 420 of the Indian Penal Code and Sections 30(a), 32(ii) (iii), 36 and 41(i) (ii) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

Learned counsel for the petitioner submits that the petitioner has antecedent of eight cases and allegation is of recovery of 1.125 liters of liquor from a truck. 4.

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot as such nothing was recovered from his conscious possession and is neither the owner nor the driver of the seized vehicle and he came to be

Patna High Court CR. MISC. No.19836 of 2024(2) dt.22-03-2024 2/2 implicated based on secret information which is the easiest way to implicate someone. It is next submitted that it appears that the police in order to save the real culprits falsely implicated the petitioner based on secret information taking advantage of his antecedents.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 40,000/- (Rupees Forty Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bidupur P.S. Case No. 772 of 2023 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
