JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-05-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Kartahan Police Station Case No. 69 of 2014 registered for the offences punishable under Sections 302,201/34 of the Indian Penal Code.
Petitioners are in-laws of the deceased and in course of investigation, it appears that not a single prosecution witness has stated against the petitioners in respect of their specific overt act and furthermore para-20 of the case diary reveals that deceased had filed a petition before the Superintendent of Police prior to her death and in that petition she had stated that her in-laws
Patna High Court Cr.Misc. No.12509 of 2015 (3) dt.05-05-2015 2/2 were separate from her.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st class, Vaishali in Kartahan Police Station Case No. 69 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
