JUSTICE BIRENDRA KUMAR ORAL ORDER 03-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 147/148/149/323/307/452 of the Indian Penal Code.

Allegation is that for some dispute the petitioner allegedly fired on the informant. However, no injury was caused to anyone.

Submission is that false allegation is there just to pressurize in earlier litigation.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.20612 of 2017 (2) dt.03-05-2017 2/2 each to the satisfaction of Mr. Raghubir Prasad, learned Judicial Magistrate, 1st Class, Begusarai/Successor Court, in connection with Naokothi P.S. Case No.51 of 2013, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
