JUSTICE BIRENDRA KUMAR ORAL ORDER 02-05-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

Petitioners are languishing in custody for the offences punishable under Section 366A/34 of the Indian Penal Code.

The statement of the victim girl under Section 164 Cr.P.C. was recorded after four years of the occurrence wherein she has alleged that she was forcefully taken away by Tetari Devi and in later part she alleged her exploitation by the named accused persons and subsequently she married with one Bablu. The petitioners are not named in the FIR.

Submission is that the matter is of love affairs. The

Considering the aforesaid facts, let petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj/Successor Court, in connection with Mirganj P.S. Case No.14 of 2012, G.R.No.202 of 2012, with condition that petitioners shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioners in this case.
