Petitioner seeks bail in a case registered under section 307 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. As a matter of fact, the petitioner and the father of the informant are partners and they used do contractual work of electricity department. The father of the informant played some fraud and when petitioner demanded his money, the present false case has been lodged. Moreover, the injury report has been produced from a Private Hospital and the

Patna High Court CR. MISC. No.11011 of 2020(3) dt.05-06-2020 2/2 victim was not treated at any Government Hospital either at Nalanda or at Patna. Petitioner has no criminal antecedent. Petitioner is in custody since 05.09.2019.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing personal bond to the satisfaction of Chief Judicial Magistrate, Nalanda in connection with Harnaut P.S. Case No. 38 of 2019.
