JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 366 and 366A of the Indian Penal Code.
The accusation is of abducting the minor daughter of the informant by Kundan Kumar non-petitioner with the help of the petitioner.
It is submitted by learned counsel for the petitioners in the statement recorded under section 164 of the Cr. P. C. the victim girl has alleged nothing against this petitioner although she alleged the accusation against Kundan Kumar and Putun Mahto and the specific accusation of established physical relation is against Kundan Kumar. The petitioner is neither named in the F.I.R. nor in the statement of the victim girl
Patna High Court Cr.Misc. No.12735 of 2015 (2) dt.26-03-2015 2/2 recorded under Section 164 of the Code of Criminal Procedure. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Town P.S. Case No. 891 of 2012 , subject to the conditions as laid down under Section 438(2) Cr.P.C.
