This application for regular bail arises out of Katihar Rail P.S. Case No. 79 of 2019, disclosing offences punishable under Sections 379, 411 and 414 of the Indian Penal Code. The petitioner was apprehended by a private person and was handed over to the police with the allegation that the petitioner had picked his pocket and when the petitioner was found fleeing away, he was apprehended by the informant and other persons. The recovery of certain articles was made by the informant with the aid of other private persons. Learned counsel appearing on behalf of the petitioner has submitted that because of an altercation, which had taken place between the informant and the petitioner, he was falsely

Considering the above submission made on behalf of the petitioner and the fact that the recovery was allegedly made by the informant, based on which he get lodged an F.I.R. with the police, in my view, case for grant of regular bail is made out. The petitioner is in custody since 18.10.2019. This application is accordingly allowed.

Let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court of Railway Judicial Magistrate, Katihar in connection with Katihar Rail P.S. Case No. 79 of 2019.
